R v Fuge (2001) 123 A Crim R 310
This case considered the issue of claim of right in relation to larceny and whether or not it is available as a defence to an accessory even though it has not been raised by the principal offender. In addition, whether or not a direction by a judge was incorrect and resulted in the shift of onus of proof to the accused in relation to a witnesses motive to lie.
