Birmingham v Renfrew (1936) 57 CLR 666

This leading Australian case examined the issue of a mutual pact between a husband of wife as to the disposition of property in each persons respective wills.  The issue was whether or not a court could enforce the way in which a testator disposed of their property if they had previously formed a contract with someone else as to the way in which they would dispose of their property.
