Sargent v ASL Developments Ltd (1974) 131 CLR 634
This case considered the right of rescission of a contract and whether or not the conduct of a party amounted to a waiver of their right to rescind a contract where they had knowledge of this right to rescission and did not act on it immediately. An issue was whether the party had satisfied the doctrine of election in relation to their right of rescission.
