Henjo Investments v Collins Marrickville (1988) 79 ALR 83
This case considered the issue of misrepresentation and whether or not silence by a party in relation to an important aspect of the sale of a business amounted to misleading conduct. The court was required to determine whether or not the party selling the business had a duty to disclose important facts relating to the true position of the business.
