The case of Curtis v Chemical Cleaning and Dyeing Co considered the issue of an exemption clause and whether or not the exemption clause was included as a term of the contract. The court distinguished between fraudulent and innocent misrepresentations and the effect in either situation on the validity of an exemption clause.
