Ace Contractors & Staff Pty Ltd v Westgarth Development Pty Ltd [1999] FCA 728
This case considered the presumption of insolvency and whether or not a company had successfully rebutted the presumption of insolvency after it failed to comply with a statutory demand. Furthermore it illustrates the discretion that the court has to decline to order the winding up of a company who is unsuccessful in this regard.
